1. Who these Terms are with, and definitions
1.1 These Terms & Conditions (“Terms”) govern your purchase and use of tickets sold by asdfasd (“asdfasd”, “we”, “us”, “our”). asdfasd is the seller and the merchant of record for your purchase.
1.2 By buying a ticket from us, you (“you”, “the buyer”) agree to these Terms. Your contract for admission to an event is with asdfasd.
1.3 In these Terms:
(a) “Event” means any ticketed event we sell tickets for - for example a concert, festival, club night, conference, exhibition, talk, screening, comedy or theatre performance, or sporting event.
(b) “Ticket” means the revocable licence to attend an Event, issued in electronic or PDF form.
(c) “Order” means your completed request to purchase one or more Tickets, accepted once checkout completes and a confirmation is issued.
1.4 Our online store and ticketing are provided for us by FoundTix Ltd, a technology provider that operates the platform and processes data on our behalf. FoundTix is not the seller of, and is not responsible for, any Event; your contract is with asdfasd.
2. Ticket purchase
2.1 By completing a purchase, you confirm that the information you provide is accurate and you accept these Terms.
2.2 Events may carry age restrictions, security requirements, or other venue rules. It is your responsibility to check and comply with these before purchasing. The age restriction for each Event is shown on the Event page and on your Ticket.
2.3 Where an age restriction or venue policy was correctly and clearly stated before you purchased, we are not responsible if you or members of your party are refused entry or removed for failing to meet it, and no refund is due in those circumstances. This does not apply where we changed, raised or incorrectly stated the age restriction, which is dealt with under clause 5.7.
3. Pricing and payment
3.1 The price shown is the total amount payable, inclusive of all applicable fees and taxes. Where a booking fee applies to your Order, it is included in the price shown to you before you pay - it is never added afterwards or revealed only at checkout.
3.2 Payment is processed securely by Stripe on our account. Your card details are collected directly by Stripe; we never see or store your full card number, expiry, or security code. If your payment is declined, your Order will not be processed and no Tickets will be issued.
3.3 We do not provide ticket insurance. If you require cover against being unable to attend, you should arrange it independently.
4. Delivery of Tickets
4.1 Tickets are delivered electronically. After a successful purchase you will receive a confirmation email with your PDF Ticket(s) attached, and your Tickets are available on your online order page, from where they can be added to Apple Wallet or Google Wallet.
4.2 If you do not receive your Tickets within a reasonable time, contact us using the details in your confirmation email or at info+wltest@foundtix.com.
5. Refunds, cancellations and changes
5.1 Change of mind. You may cancel your Order within twenty-four (24) hours of purchase for a full refund, except where your purchase was made within twenty-four (24) hours of the Event start time, in which case no change-of-mind refund is available. No other refunds are available for change of mind, and we may decline change-of-mind refunds where we detect repeated or abusive activity.
5.2 Event cancellation. If an Event is cancelled and will not be rescheduled, you are entitled to a full refund of the Ticket price. Refunds are issued only to the original purchaser and only to the original payment method, regardless of who ultimately holds or uses the Ticket.
5.3 Rescheduling. If an Event is postponed or rescheduled, your existing Ticket remains valid for the new date and we will notify you once we are aware. If the new date is one (1) month or more away, you have fourteen (14) calendar days from notification to request a full refund; if it is less than one (1) month away, you have seven (7) business days from notification, or until forty-eight (48) hours before the new start time, whichever is sooner.
5.4 Change of venue. If the venue changes, we will notify you as soon as reasonably possible, and you have seven (7) business days from notification, or until forty-eight (48) hours before the Event start time, whichever is sooner, to request a full refund.
5.5 Change of headline act or principal participant. For a single-headline Event, if the advertised headline act - or, for non-performance Events, the advertised keynote speaker or principal billed participant - changes, we will notify you and you have seven (7) business days from notification, or until forty-eight (48) hours before the start time, whichever is sooner, to request a full refund. For festivals, multi-artist bills, multi-speaker conferences and similar multi-participant Events, no refund is available for a change to, or withdrawal of, any individual act or participant.
5.6 Minor changes. Event details including supporting acts, set times and running order may change. These are minor changes that do not materially alter the Event, and no refund is available for them.
5.7 Mis-listed or corrected Event details. If we have incorrectly listed an Event and, after you purchased, correct or change a material detail of it - for example the date, the age restriction, the line-up or the venue - you may request a full refund of the Ticket price. This includes where we set the wrong minimum age and later raise or correct it, in which case you may request a full refund up to 120 days from the date of purchase.
5.8 How to request a refund. Where you are entitled to a refund under this clause 5, follow the instructions in the notification email you receive, or contact us at info+wltest@foundtix.com, before the applicable deadline. Refunds are processed to the original payment method and only to the original purchaser, regardless of who holds or uses the Ticket. Nothing in this clause limits your statutory rights as a consumer.
5.9 Complimentary and guest-list Tickets are issued at no charge and are not refundable or resellable.
6. Ticket security and gifting
6.1 Unless stated otherwise for a particular Event, Tickets are not name-specific and may be gifted to friends or family for their attendance. Gifting permits the recipient to attend only and does not transfer any contractual rights under these Terms; in all matters including refunds we communicate only with, and refund only, the original purchaser.
6.2 Each Ticket’s QR code is valid for one (1) entry only. If a Ticket is copied, shared or duplicated, only the first valid scan will be admitted; any subsequent presentation may be refused without refund. You are responsible for keeping your Ticket secure.
7. Resale
7.1 We may prohibit or restrict the resale of Tickets. Reselling a Ticket above face value, or using a Ticket for unauthorised commercial purposes, may render the Ticket void and result in refused admission without refund. This does not prevent you gifting a Ticket under clause 6.
7.2 Where we offer an official face-value resale facility for an Event, that is the only authorised way to resell a Ticket. While a Ticket is listed it is void for entry and will not scan; if it sells, it transfers to the new buyer and you are refunded to your original payment method once the new buyer’s 24-hour change-of-mind period has passed; if it has not sold by 24 hours before the Event, it is returned to you and is valid again.
8. Liability and force majeure
8.1 To the fullest extent permitted by law, we are not liable for personal injury, illness, property damage or other loss arising from your attendance at an Event, except where such liability cannot be excluded by law. You accept the inherent risks of attending an Event, which depending on the Event may include loud music, strobe and other lighting effects, large crowds, or other hazards.
8.2 We are not liable for any failure or delay in performance caused by events beyond our reasonable control. Where an Event cannot proceed for such reasons and will not be rescheduled, refunds are handled under clause 5.2.
8.3 Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including your statutory rights as a consumer.
9. Data protection
9.1 We process your personal data as the data controller, in accordance with our Privacy Policy and applicable data protection law. Please see it for details of what we collect and how it is used.
10. Governing law
10.1 These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them. This does not deprive you of the protection of any mandatory consumer laws of your country of residence.
11. Changes to these Terms
11.1 We may update these Terms from time to time. The version in force at the time of your purchase applies to that purchase.
